How much does it cost to make a personal injury claim?

If you have been injured in an accident the last thing you should be worrying about is the cost of your personal injury case. That's why with our normal funding arrangements, there are no upfront costs or unexpected fees. But if your case is won you may have to pay some legal costs from your compensation at the conclusion of your claim.

Do you take any of my compensation?

If you win, you are responsible for our costs but we actually recover the majority of these directly on your behalf from the Defendant and/or their insurance company. If the amount recovered from the Defendant does not cover our basic charges and disbursements, we will not seek the balance from you.

However in certain circumstances, when we charge a success fee this cannot be recovered from the Defendant and will be payable by you at the conclusion of your claim. This payment will be deducted from the compensation that you recover and will never exceed 25% of what you recover for injury and other past losses.

If you have taken out after the event legal expenses cover to protect you against having to pay the other sides costs, the premium is also deductible from the compensation you recover.

Why can't I receive 100% of the compensation?

Changes in the law from April 2013 mean that if you win your case you may need to pay some of your own legal fees from your compensation, as success fees can no longer be recovered from your Defendant.

As a result, when your claim is dealt with under a CFA (commonly known as a no win no fee agreement) the success fee is payable by you.

However in some circumstances where you have pre-existing legal expenses insurance cover and your insurance company has agreed for us to act on your behalf, success fee deductions may not need to be made.

How much do personal injury lawyers charge?

The cost of a personal injury lawyer to work on your claim varies from case to case. Our solicitors charge a basic fee along with the disbursements needed to progress your case, these may include:

  • Cost of an accident report
  • Barrister fees if your case goes to court
  • Cost of gaining copies of medical records
  • Travelling expenses

As already mentioned, you do not need to worry about these as the majority of legal costs will usually be covered by the other (losing) side.

Lawyers also charge a success fee. This fee is a percentage of the billable work that we carry out on your case, and we receive this only if your claim is successful. This percentage varies depending on the risks and complexities involved with your case, and will be agreed upon before any work is started on your claim.

So if you're wondering how much does an injury lawyer cost, the short answer is generally nothing upfront and any deductions for a success fee can only be a maximum of 25% of your damages should we be successful in winning your claim.

Do I pay tax on the compensation payment?

No, payments you receive in respect of your personal injury compensation are not taxable.

What happens if I lose my claim?

We will act on your behalf on a no win no fee basis. This means that as long as you comply with our terms and conditions, you will not have to pay our charges if you lose your claim.
