Spencers Solicitors welcome the introduction of new legislation (June 2019) which will assist the victims of violent crime and domestic abuse.
The ‘same roof’ rule was deemed to be outdated and flawed, denying genuine claims from victims and has now been abolished.
The law previously prevented victims who lived under the same roof as their attacker from claiming compensation for their injuries. This included sexual assault on children who were abused by members of the same household.
Incidents occurring between August 1964 and 30 September 1979 are now to be considered, allowing victims who have previously been denied an award, or who did not come forward at the time, to make an application, providing the Scheme’s criteria is met. The time limit for the historic applications is 2 years from 13 June 2019.
All other CICA claims should be made within 2 years of any assault.
