As well as many statutory changes to employment law occurring in 2020, we will also be finding out the outcome to some very big cases that could have a drastic effect on employment rights.
The top 5 cases that I will be keeping an eye on are:
Royal Mencap v Tomlinson Blake: The Supreme Court will make a final decision on payment for sleep in shifts. The hearing is listed for February 2020.
Morrisons supermarket: The Supreme Court heard how an ex-employee with a grudge had leaked data about the supermarkets staff - we will find out in the new year if they hold Morrisons vicariously liable for these actions.
Asda v Brierley: can warehouse and retail operators be compared for the purpose of equal pay claims? This is the question that the Supreme Court will be asking itself with many supermarkets waiting for the outcome.
Uber BV v Aslam: The Supreme Court will finally decide on whether an Uber driver is classed as a worker or self-employed. This is due to be heard in July 2020.
Dewhurst v Revisecatch & City Sprint: as per my article last month about this case, the claim has been referred to the Employment Appeals Tribunal for their opinion on whether workers will transfer under TUPE.
